Terms and Conditions

Please read these Terms and Conditions (“Terms” or “Terms and Conditions”) carefully before using http://www.millesaisons.co.uk or purchasing goods from by Mille Saisons Ltd (“us”, “we, “our” or “supplier”).

 

Your access to and use of the website is based on your acceptance of and compliance with these Terms. These Terms apply to anyone who accesses or uses this website.

 

These Terms also apply to the purchase of the goods by you (“the Customer”, “the Consumer”or “you”). Mille Saisons Ltd. is a company registered in England and Wales under number 09029357 whose registered office is at 9 Fern Place, 2 Alice Court, Burgess Hill, RH15 9ET . These are the Terms on which we sell all Goods to you. By ordering any of the Goods, you agree to these Terms and Conditions.

 

Contract means the legally-binding agreement between you and us for the sale and purchase of the Goods.

 

Goods means any goods that we supply to you, of the number and description as set out in the order.

 

Order means the Customer’s order for the Goods from the Supplier as set out in the Customer’s order.

 

Goods

 

The description of the Goods (“products”) is as set out on our website Any description is for illustrative purpose only and there may be small discrepancies in colour and size. We cannot guarantee the accurate display of colour on your computer monitor. In the case of items made to your special requirements, it is your responsibility to ensure that any information you provide is accurate.

 

Basis of Sales

 

The description and display of the Goods on our website or other form of advertisement does not constitute a contractual offer to sell the Goods. When you place an Order, this is an offer to buy the Goods from us. We will send you an email acknowledgement of your Order. Please note that this email is an acknowledgement of your order and is not an acceptance of your order. A Contract will only be formed for the Goods ordered only once we have dispatched your order and sent you an email confirming this. We are under no obligation to supply the Goods although we will endeavour to tell you the reason as soon as possible for example, if the product is out of stock.

 

Delivery of Goods

 

We aim to dispatch your item as quickly as possible and this will usually be within 1-4 working days subject to payment clearance, address verification and availability of items. In these cases, we reserve the right to delay the dispatch of an order but we will contact you if we must delay the dispatch beyond our usual dispatch time frame.

 

As we are based in the UK, all goods are shipped from the United Kingdom, therefore orders made from countries outside of the U.K may be subject to further duties and import costs. Mille Saisons is not liable for the costs and they must be covered by the customer. Items returned following refusal to pay duties and import taxes are considered forced returns.

From 1st July 2021 in the EU, import duties, taxes and handling fees will be charged by your relevant customs authority as our prices are not inclusive of these. Please refer to your customs authority for more information on charges prior to purchase. Buyers are responsible for any customs and import taxes that may apply and are liable for paying the charges.

Custom duties to all other international countries will remain the same and you can still check with your country’s customs office to find out more information on application duties.

Orders will be sent to the address provided so please ensure this is correct as Mille Saisons cannot be held responsible for any orders that do not arrive due to incorrect addresses. Orders which are returned to Mille Saison due to incorrect addresses are classed as forced returns and repostage costs will need to be covered by the customer.

Shipping estimates for abroad are based on time frames given by Royal Mail and on your package entering your country. Please be aware that parcels may take longer to be processed through customs.

All time scales are estimates and we cannot be held responsible for delays in shipping beyond our control after dispatch such as adverse weather conditions or postal delays.

Please be aware that shipping estimates are estimates only and if you require faster shipping, please get in contact for a courier quote. Items are not considered lost by the mail service until 10 working days after the estimated arrival date within the UK, after 25 working days for European orders and 32 working days for the rest of the world.

Import duties

Please note if you refuse to pay any customs duties on your order then this will be classed as a refused delivery and will not be eligible for any postage refunds. Refunds will only be given when the order has arrived back and unfortunately with refused items, this is not always guaranteed or can take months to return.

 

Payment

 

Payment can be made by Paypal, Visa, Visa Electron, Visa Debit, Visa Delta, MasterCard, Maestro, American Express and any other methods which may be shown on the Site.

 

You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use the card. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

 

We take care to ensure that your shopping experience is safe and secure but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from us.

Clearpay lends you a fixed amount of credit to allow you to pay for your purchase over 4 instalments, due every two weeks. To be eligible for credit from Clearpay, you must be a permanent UK resident (excl Channel Islands), aged 18+. Further eligibility criteria and T&Cs apply. Clearpay Finance Ltd.

 

Make sure you can make your repayments on time by each due date to avoid late fees. Not paying on time will lead to a late fee of £6, and, if your order is more than £24, a further late fee of £6 if it is still overdue after 7 days. If you fail to pay on time, your Clearpay debt may be passed to a debt collection agency and this may affect your ability to use Clearpay in future.


We encourage you to use Clearpay responsibly.

Discount Codes

Discount codes are not valid on sale items, custom or made to order items, introductory prices, face masks or sets with a value saving already applied. Mailing list subscription discount code can only be used once per person and discounts cannot be applied after an order has been placed.

Cancellation

 

You may withdraw the Order before the Contract is made if you change your mind. If you are based in the EU you also have the right to cancel your order under the Consumer Contracts Regulations so long as you give us written notice by email to jo@millesaisons.co.uk or info@millesaisons.co.uk within 14 days. You must return the Goods in a new and saleable condition if they have been shipped and we will refund you in full. The customer is responsible for the return postage. This does not affect your rights when the reason for cancellation is any defective Goods.

 

Returns and exchanges

 

We hope you love your items. However, if you wish, you may return your item to us. Please let us know within 14 days of delivery if you would like a refund. You then have another 14 days to return the item to us in perfect, unworn condition including any gift packaging for a refund or exchange. If you wish to return or exchange an item, please email jo@millesaisons.co.uk. We will then authorise your return. The original postage cost to send your order to you will be refunded (for shipping upgrades, the cost of standard shipping will be refunded).

Unfortunately we are unable to offer refunds, exchanges or cancellations on personalised or custom orders unless in the rare circumstance where the error is Mille Saisons' responsibility (while these instances are very unusual, I am only human! In these cases I will always refund or remake your order completely to make it right) or there is a fault or damage during transit. Please note that it is your responsibility to check the measurements to ensure custom orders will work for you as orders made to the size specified are not eligible for change of mind returns. You also have the right to cancel an order within 14 days of ordering as per the Consumer Contracts Regulations. If your order has already shipped then you will need to return it for a refund. Please note that your order may have already shipped as dispatches can take 24 hours to be processed.

 

You can exchange any item for a different size or colour or for a replacement product. You will need to pay for the exchange postage and the difference for a more expensive item and we will refund the difference if it is cheaper. Email jo@millesaisons.co.uk to organise an exchange.

 

Returned items are your responsibility until they have arrived back and must be returned in the same condition as they arrived.  Mille Saisons will only refund the return postage costs for damaged items. Goods are considered damaged only if they are received damaged; items that are damaged as a result of normal wear and tear are not considered to be faulty. Goods not returned in the condition in which they were sent out may be subject to deductions or may no longer be eligible for a refund. While rare, when a return arrives back to Mille Saisons marked or damaged, I am happy to resend it your return back to you. You will need to cover the return postage in this case.

Mille Saisons is not liable to cover the cost of refunding any customs fees or import duties. You should be able to apply to the collecting body for a refund in cases where you have returned your order.

Orders including a free gift will need to be returned with the free gift. Partially returned orders with a discount for ordering over a certain value will have the refund calculated according to the discount and threshold. For example, if part of a £120 order with a 20% off discount for orders over £100 is returned and the value of the order has now dropped under the £100 threshold, then the 20% discount will no longer be included and your refund will be calculated to include this.

 

We recommend you send your item back using a recorded delivery service as Mille Saisons cannot offer refunds for items that do not reach us. Please also mark returns from outside of the UK on the package as a returned item as customs charges incurred from failure to do this will be deducted from the refund value.

Refunds and exchanges will be processed within 14 days after they are received back.

In the unlikely event that you receive a faulty product or a fault develops, please email jo@millesaisons.co.uk so that we can sort this out for you. In the event that you need to return a faulty item, we will cover the return postage costs or organise a replacement.

The Mille Saisons logo and all other marks, trade names, service marks, brand names, business names, illustrations, logos, prints which appear on the products on the website or their packaging, whether registered or unregistered are either ours or licensed to us and are protected by applicable trade mark laws around the world. All rights are reserved.

 

All other intellectual property in or connected to the website, our products, or any related packaging, stationery, marketing material, or in any other way are either ours or licensed to us and such rights are protected by the applicable laws around the world.

 

Your use of the website and its contents grants no rights to you in relation to any copyright, designs, trademarks and all other intellectual property and material rights relating to its content.

External links may be provided on the website which may contain useful information to our customers. External links are beyond the control of the Website and we make no representation as to their content. Use of external links is therefore at your own risk.

By placing an order you agree and understand that we may store and process your personal data in accordance with our Privacy Policy. Governing Law

 

The Contract and these Terms are governed by the law of England and Wales.
